INVESTIGATION PARTICIPATION AGREEMENT

AND

WAIVER OF LIABILITY

This Agreement is entered into between the undersigned participant (“Participant”) and Team SPECTRE, LLC (“SPECTRE”), Always Dreaming Enterprises, LLC (“Dreaming”), Warren Investments LLC/dba Comfort Inn (“Warren”) and Dark Xmas (“Dark”) as of the date of Participant’s signature in connection with Participant’s participation in a paranormal investigation at 136 N. Park Ave., Warren, Ohio 44481, being conducted by SPECTRE.

1.  Participation Fees.  Participant will pay to Dreaming, prior to participating in the paranormal investigation, a fee based on the following fee schedule:

            Ghost Basics Class (no participation in investigation)            $25.00

            Ghost Basics Class & participation in investigation                  $45.00

            Ghost Basics Class, participation in investigation

            And a set of dowsing rods                                                     $55.00

Participant agrees that all fees paid are NOT REFUNDABLE.  If Participant subsequently decides not to participate in the activity for which Participant paid after payment has been made, no portion of the payment will be refunded under any circumstances.

2.  Compliance with Directives.  Participant agrees to comply with all directives given by any SPECTRE personnel.  Failure to do so will result in Participant being asked to discontinue participation in the investigation and no portion of the fees paid by Participant will be refunded.

3.  Waiver of Liability.  As a condition of participation in the investigation, Participant shall assume the risk of injuries to their person, including, without limitation any and all physical, emotional and/or psychological injuries, or injuries to their property, and the person or property of others arising out of his or her participation in the investigation, and does hereby release SPECTRE, Dreaming, Warren and Dark, and their principals, officers, agents, employees, successors and assigns, and all others acting in concert or participation with SPECTRE, Dreaming, Warren and/or Dark from and against any claim, demand or liability arising out of such injury, and will protect and indemnify SPECTRE, Dreaming, Warren and/or Dark and those persons released with respect to any claim, demand or liability arising out of such injury.  Participants will be liable for any damages done to any person, equipment or the premises on which the investigation is conducted.

4.  Consent to Use of Likeness and Voice.  Participant understands and agrees that during the course of the investigation representatives of SPECTRE may make audio, video and/or photographic recording of any and all events that occur during the investigation, which may include Participants voice and/or likeness.  Participant agrees that any and all such recordings shall be the sole and exclusive property of SPECTRE and that SPECTRE is hereby authorized to use Participant’s voice and/or likeness in any manner it so chooses without any further agreement by Participant.

5.  Participant’s Recordings.  Participant may make audio, video and/or photographic recording of the investigation, unless instructed otherwise by SPECTRE prior to or during the investigation.  However, Participant agrees that upon request by SPECTRE a copy of any such recordings will be provided to SPECTRE at no charge, other than the cost of duplication, and that SPECTRE will have the right to utilize any such recordings in any way it chooses without further agreement by, or any compensation to, Participant.
